fa تعارض بین حقوق بشر و امنیت سیاسی چالش ها و راهکارها Conflict between human rights and political security, challenges and solutions تخصصي Special پژوهشي Research زمینه و هدف: تعارض بین حقوق بشر و امنیت سیاسی یکی از چالش‌های بزرگ در جوامع مدرن است که نیازمند بررسی و توجه ویژه است. حقوق بشر به عنوان یک حق و آزادی‌هایی که هر انسان به عنوان شخصیتی برابر و با ارزش باید از آن بهره‌مند باشد و امنیت سیاسی به عنوان ابزار حفظ امنیت و استقرار نظم در جامعه و کشور نقشی مؤثر را ایفا می‌کند و گاه این دو دچار چالش می‌گردند. نقش این مسأله ارائه‌ی راهکارهایی  جهت رفع تعارضات ایجاد شده به واسطه‌ی چالش‌ها است. روش: در مقاله حاضر که به روش توصیفی_تحلیلی و بر پایه مطالعات کتابخانه‌ای و تجزیه و تحلیل مقالات علمی انجام شده، مطالب حقوقی مرتبط با حقوق بشر و امنیت سیاسی مورد بررسی قرار گرفته است و مطالب موجود در ادبیات مرتبط با موضوع بررسی می‌شود. این مرور به ما کمک می‌کند تا دانش موجود در این زمینه را دریابیم و مفاهیم مهم را معرفی کنیم. برای انجام تحقیق، نیاز به داده‌ها و اطلاعات دقیق بود که با کمک  منابع کتابخانه‌ای جمع‌آوری شده است و داده‌های تحلیل شده تا الگوها، ارتباطات و مفاهیم کلیدی شناسایی شوند. سپس نتایج تحقیق و استنتاج‌ها ارائه می‌شوند و به سوالات تحقیق پاسخ داده شده است. یافته‌ها: مسأله‌ی حقوق بشر و امنیت سیاسی از اهمیت بالایی برخوردار است و ارائه‌ی راهکارها در حل تعارضات فی مابین، تاثیرگذار می‌باشد. از جمله راهکارهای حل تعارض بین این دو مسأله تعادل میان دو عنصر حقوق بشر و امنیت سیاسی و توسعه همکاری‌های بین المللی و تقویت نظام قضایی است. تعارض بین حقوق بشر و امنیت سیاسی به واسطه چالش‌هایی وجود دارد. این تعارض‌ها شامل تضاد محدودیت حقوق اساسی در راستای امنیت سیاسی و بی‌تفاوتی نسبت به امنیت سیاسی در جهت حفظ حقوق انسانی است. راهکارهایی برای حل و فصل این تعارضات از جمله توسعه قوانین و سیاست‌های مناسب، تقویت همکاری‌های بین‌المللی، ترویج فرهنگ حقوق بشر و تعادل بین حقوق و مسئولیت‌ها ارائه گردیده. در این مقاله به این سوال که چه چالش‌ها و راهکارهایی در تعارض بین حقوق بشر و امنیت سیاسی وجود دارد؟ پاسخ داده و تأکید شده که با اتخاذ این راهکارها، می‌توان تعارض بین حقوق بشر و امنیت سیاسی را بهبود بخشید و به جامعه‌ای پویا و پایدار دست یافت. این تلاش‌ها می‌توانند به حفظ حقوق اساسی افراد و همچنین حفظ امنیت و استقرار نظم در جوامع مدرن کمک کنند.     Background and purpose: The conflict between human rights and political security is one of the biggest challenges in modern societies, which requires special consideration and attention. Human rights as a right and freedoms that every human being should benefit from as an equal and valuable personality and political security as a means of maintaining security and establishing order in the society and the country plays an effective role and sometimes these two are challenged. . The role of this issue is to provide solutions to resolve conflicts caused by challenges. Method: In the present article, which was carried out using a descriptive-analytical method and based on library studies and analysis of scientific articles, the legal materials related to human rights and political security are examined and the materials available in the literature related to the subject are examined. This review helps us to find out the existing knowledge in this field and introduce important concepts. To carry out the research, it was necessary to collect detailed data and information with the help of library resources and analyze the data to identify patterns, connections and key concepts. Then the research results and conclusions are presented and the research questions have been answered. Findings: The issue of human rights and political security is of great importance and providing solutions is effective in resolving conflicts between them. Among the ways to solve the conflict between these two issues are the balance between the two elements of human rights and political security, and the development of international cooperation and the strengthening of the judicial system. The conflict between human rights and political security exists due to challenges. These conflicts include the contradiction of limiting fundamental rights in the direction of political security and indifference to political security in order to preserve human rights. Solutions for resolving these conflicts, including the development of appropriate laws and policies, strengthening international cooperation, promoting the culture of human rights and balancing rights and responsibilities, have been presented. In this article, what challenges and solutions exist in the conflict between human rights and political security? It has been answered and emphasized that by adopting these solutions, the conflict between human rights and political security can be improved and a dynamic and stable society can be achieved.
