fa توسعه دموکراسی در دیوان اروپایی حقوق بشر تخصصي Special پژوهشي Research <span style="font-size:11pt"><span style="line-height:normal"><span style="direction:rtl"><span style="unicode-bidi:embed"><span sans-serif="" style="font-family:Calibri,"><span lang="FA" style="font-size:10.0pt"><span b="" style="font-family:" zar="">در دهه‌ی حاضر کمیته‌هایی چون حقوق بشر، کمیسیون‌های اروپایی، دیوان بین‌الملل دادگستری، سازمان‌های بین‌المللی اروپا و مجمع عمومی سازمان ملل متحد رویه‌ای بی‌سابقه از توجه بین‌المللی به ساختار حکومت‌های داخلی و ایجاد رژیم‌های دموکراتیک به وجود آورده‌اند در بعد وسیع و فراگیر در سطح بین‌المللی این سازمان‌ها یا به صورت اصلی و ذاتی و یا به صورت فرعی و واسطه‌ای متولی حمایت از آزادی‌های اساسی و حقوق بنیادین بشر می‌باشند که یکی از آنها محاکم منطقه‌ای حقوق بشر بوده که در این مقاله نگارنده به مواردی از قبیل آنکه چگونه از رهگذر آراء صادره محاکم منطقه‌ای حقوق بشر می‌تواند به توسعه مفهوم دموکراسی منتهی شود؟ در این آراء مؤلفه‌های دموکراسی به چه صورت تفسیر می‌گردد؟ شرایط و اوضاع و احوال هر قضیه، چگونه در قالب آراء مدنظر قرار می‌گیرد؟ طبق رویه معمول همیشه، موضوعات و قواعد در بستر آراء حقوقی تفسیر و اجمال و ابهامات آنها مرتفع می‌شود، همانطور که رویه نهادهای شبه قضایی بین‌المللی و همچنین ساختارهای قضایی منطقه‌ای در توسعه و استحکام قواعد عرفی مؤثرند. پس لازمه دست یافتن به پاسخ سؤالات مذکور، بررسی آراء صادره مربوطه از محاکم منطقه‌ای حقوق بشر و کشف نحوه تفسیر، تشریح، برخورد و تصمیم‌گیری آنها نسبت به مؤلفه‌های دموکراسی می‌باشد چرا که این محاکم منطقه‌ای، علی‌الخصوص دیوان اروپایی حقوق بشر بیشتر از سایر مناطق دیگر نسبت به حق‌های بنیادین که مدنظر حکومت دموکراتیک هست، پرداخته‌اند. که تأثیر بسزایی در آینده بر توسعه دموکراسی از طریق رویه‌این محاکم ایجاد خواهد نمود.</span></span></span></span></span></span></span><br> &nbsp; n the current decade, committees such as human rights, European commissions, the International Court of Justice, European international organizations and the United Nations General Assembly have created an unprecedented practice of international attention to the structure of domestic governments and the creation of democratic regimes in the wide and comprehensive dimension of these organizations at the international level. Either in a main and intrinsic way or in a secondary and intermediary way, they are in charge of protecting basic freedoms and fundamental human rights, one of which is the regional human rights courts, which in this article, the author discusses things such as how through the decisions issued by the regional human rights courts Can humanity lead to the development of the concept of democracy? How are the components of democracy interpreted in these votes? How are the circumstances of each case considered in the form of votes? According to the usual procedure, issues and rules are interpreted in the context of legal opinions and their ambiguities are resolved, just as the procedure of international quasi-judicial institutions as well as regional judicial structures are effective in the development and strengthening of customary rules. Therefore, it is necessary to get the answers to the mentioned questions, to examine the relevant judgments issued by the regional human rights courts and to discover how they interpret, explain, treat and make decisions regarding the components of democracy, because these regional courts, especially the European Court of Human Rights, are more than other regions.
